This morning my daughter was at a 4 way stop sign. She approached and stopped at the stop sign. At the same time there was a school bus approaching the intersection and stop sign to her right, The bus had the yellow flashers on as they approached. My daughter proceeded through the intersection after she stopped at the sign as the bus had not reached the stop sign yet. She gets halfway through the intersection and the bus puts on the red lights and stop sign. My daughter is now in the middle of a 4 way intersection. She did not stop and the bus drive proceeded to scream at her and honk. What do we do if we get a citation in the mail. Should she have stopped in the middle of the intersection???

Your daughter should have a valid defense to the charge. Here is the pertinent portion of the no passing a school bus law: "The driver of a vehicle approaching an intersection at which a school bus is stopped shall stop his vehicle at that intersection until the flashing red signal lights are no longer actuated." If your daughter was already in the intersection before the bus is stopped she has the right to clear the intersection. If she is cited she should speak with a lawyer because of the suspension that accompanies a conviction of this offense. Good luck!

While she probably should not have gone through the intersection, she also probably should not get cited for it. The yellow lights indicate to proceed with caution. IF she does get a citation in the mail, she needs to plead NOT GUILTY and get an attorney as soon as possible.

Your daughter has a defense but due to the suspension possibility should retain a criminal defense attorney to represent her in the event she is cited.
